Our Experience and Credentials
The majority of our firm’s practice centers around estate and probate matters, including issues that are contested in probate court. We have extensive experience in the courtroom representing clients in disputes regarding the validity of wills, complex administrations, executor misconduct, creditor claims, and guardianships.
The firm is respected in the Tarrant County legal community, and many of our clients are referred to us by attorneys and other professionals who are familiar with our work. We take great pride in our reputation for meticulous attention to detail and exceptional client service.
Our attorneys’ experience includes not only many years serving clients in private practice but working in the local probate courts. Attorney Bob Loudermilk, the firm’s founder, worked as staff attorney at Tarrant County Probate Court No. 2. In that capacity, he routinely dealt with litigated probate and guardianship matters and became deeply familiar with court protocols and processes; that knowledge informs his work with clients in private practice.
Loudermilk Law’s depth and breadth of probate litigation experience enable the firm to provide clients with sound advice and effective advocacy in Texas probate litigation.
Texas Probate Litigation
The Texas Estate Code has established the probate process to settle the estate of a deceased individual (decedent). Unfortunately, in the process of administering a decedent’s estate, disputes arise which must then be litigated through the probate court.
Probate litigation often includes disputes over such matters as:
- Whether the decedent had testamentary capacity when the will was made
- Whether the decedent made or changed a will due to fraud, undue influence, or duress
- Other issues affecting the validity of a will or trust
- Conflict between heirs or beneficiaries of an estate or trust
- Claims of a creditor of the estate
- Misconduct by an executor or administrator of an estate, trustee or guardian
- Breach of fiduciary duty by a trustee or other fiduciary
- Claims related to informal marriages, including long-term partners alleging common law marriage
- Misconduct by agents acting as attorneys in fact under a power of attorney
Disputes regarding the capacity and potential guardianship of an adult are also litigated in the probate court. We are committed to handling these matters, like all probate disputes, with the care and sensitivity they deserve.
