Texas Probate Litigation

The Texas Estate Code has established the probate process to settle the estate of a deceased individual (decedent). Unfortunately, in the process of administering a decedent’s estate, disputes arise which must then be litigated through the probate court.

Probate litigation often includes disputes over such matters as:

  • Whether the decedent had testamentary capacity when the will was made
  • Whether the decedent made or changed a will due to fraud, undue influence, or duress
  • Other issues affecting the validity of a will or trust
  • Conflict between heirs or beneficiaries of an estate or trust
  • Claims of a creditor of the estate
  • Misconduct by an executor or administrator of an estate, trustee or guardian
  • Breach of fiduciary duty by a trustee or other fiduciary
  • Claims related to informal marriages, including long-term partners alleging common law marriage
  • Misconduct by agents acting as attorneys in fact under a power of attorney
